Stuck Without an Executor or Trustee? Why You’re Not as Alone as You Think

It’s a common—and stressful—roadblock for many people when they walk into our office: the concern that they don’t have an obvious choice for an executor, trustee, or power of attorney.

This might be because you don’t have adult children. Or, perhaps you have concerns about your children’s ability to manage complex legal or financial decisions. Regardless of the reason, this uncertainty is a frequent driver for delaying essential estate planning.

If you find yourself in this position, I want to offer some perspective: You are likely not as alone in this as you think.

You Don’t Have to Do It Alone (and Neither Does Your Representative)

A common misconception is that the person you name as your executor or trustee must personally possess deep expertise in law, finance, and administration. They do not.

When you designate someone to act for you in the event of your incapacity or death, they are not stepping into a vacuum of responsibility. They can—and should—seek professional advice.
