About Clarity Legal Group®

Life is full of wonder, joy, love—and challenges. Our quality of life is often defined by how well we meet these challenges. Mark started Clarity Legal Group® to help people face two important challenges: incapacity and death. Mark and his team use NC Estate Planning, Wills, and Living Trusts to provide the planning, tools, and support necessary to protect clients and their loved ones from what might go wrong and help them realize their hopes for what might go well. In so doing, we aim to give our clients peace of mind and contribute to their legacy of a life well lived.

Everything about the culture at Clarity Legal Group® is geared toward providing clients extraordinary clarity in the face of the unfamiliar details and challenges of preparing for incapacity or death. Our approach takes the uncertainty out of decisions about estate planning and elder law.

Before a client engages our services, we will provide clarity about what is needed, what the options are for preparing more fully, how and when the plan will be delivered and implemented, what will be expected of the client during the process, and what clients will pay us. We prepare prospective clients through education in multiple forms, calculated to make the time clients invest with our lawyers productive and the decision to use our services clear and easy.

To learn more about our estate planning approach, read our Estate Planning articles. You can also join us at an Estate Planning seminar.

NC Estate Planning: Wills and Living Trusts

Our firm helps families keep their wealth for future generations, minimize estate taxes, and avoid the nightmare of probate. We use several legal tools. These include:

  • Living Trusts
  • Wills (simple & complex)
  • Powers of Attorney
  • Living Wills
  • Irrevocable Trusts
  • Family Limited Partnerships

Digital Estate Planning

If you are reading this page, then you almost certainly have a digital estate. And if you are like most people, you haven’t done anything to plan for your “digital afterlife.” Depending on your digital estate, you may have intellectual property rights to protect. You might also have real economic interests in money in an online seller account. You might have personal and sentimental information. Your family may want to access or keep this information if you pass away. You might have virtual currency or property that has real economic value. This should be included in your estate plan. In today’s digital age, it is important to plan for keeping or disposing of digital assets.

Legacy Planning

Legacy Planning is a more holistic approach to estate planning. We help clients protect their financial wealth and legacy for future generations. This includes their life stories and family heirlooms.

We have special planning methods. These methods include unique features in:

  • Living Trusts
  • Wills (both simple and complex)
  • Powers of Attorney
  • Living Wills
  • Irrevocable Trusts
  • Family Limited Partnerships
  • Charitable Gifting Strategies

This planning also aims to lower estate taxes. Living trusts help avoid the costs and issues of probate. Comprehensive estate planning protects against remarriage after the first spouse dies; it also shields beneficiaries from a possible future divorce.

Legacy Real Estate Trust

All of your children have wonderful memories of time spent at the family beach or mountain house. These well cared for properties have increased in value over the years and are the place of a lot of family memories. It makes sense for the family to continue to hold this property for generations. However, with each generation, the family is larger and more spread out. Will it always make sense to hold the property in the family? As the generations come and go, how does the family manage the use and care of these properties?

Family-Owned Businesses & Farms

Our law firm offers estate planning assistance for the unique needs of Family Businesses and Farms. We help clients preserve this important part of their legacy for future generations.

Estate Planning for the LGBTQIA+ Community

We offer guidance and assistance to members of the LGBTQUIA+ Community on their unique estate planning needs. This includes assistance in setting up Living Trusts, and Health Care Directives.

Incapacity Planning

Our law firm helps clients create a plan to handle their affairs in the event of an incapacity before they pass away. This includes planning to avoid a Living Probate or Guardianship proceeding.

IRA & Retirement Planning

Our law firm has experience in the complex area of estate planning with IRAs and other retirement plans. We help ensure clients and their beneficiaries are protected by employing tax reduction techniques.

Elder Law & Medicaid Services

We help clients qualify for government medical benefits legally. We implement the right tools to protect their estates for their families, ensuring high nursing home costs don’t wipe out their savings.

Asset Protection & Business Planning

We help clients who are small business owners and those who are most susceptible to being sued by assisting with Lawsuit and Asset Protection. We also assist with Business Succession Planning and Small Business Planning. Some of the tools and strategies used are Family Limited Partnerships, Limited Liability Companies and Buy-Sell Agreements.

Special Needs Planning

We offer assistance to clients who have special needs family members by creating Special Needs Estate Plans. These tailored plans help them keep government benefits. They ensure their loved one receives care in all areas of life. This includes financial, educational, medical, and, most importantly, emotional and personal needs for the future.

Trust Administration & Probate

We assist families who have lost a loved one with the Probate or Trust Administration process that follows.
