At Clarity Legal Group, we emphasize the importance of understanding and accessing all the benefits available to veterans and their families. One critical yet often overlooked benefit is the Veterans Aid & Attendance (VA&A) benefit. For veterans or their surviving spouses living on a fixed income, VA&A benefits can significantly impact financial well-being, especially when long-term care becomes necessary. Here’s an overview of this program and what you need to know to determine if you or your loved one may qualify.
What Is Veterans Aid & Attendance?
Veterans Aid & Attendance provides additional financial assistance to eligible veterans who already qualify for a VA pension and need help with daily living activities. This benefit can be used to help cover the costs of in-home care, assisted living, or a nursing home, making a huge difference for families facing rising healthcare costs. If you or a loved one is already receiving a VA pension, the VA&A benefit increases your pension to help manage the extra costs related to long-term care.
Eligibility for Veterans Aid & Attendance
To qualify for VA&A, you must first meet the basic eligibility for a VA pension (for veterans) or Dependency and Indemnity Compensation (DIC) (for surviving spouses). Additional criteria include:
Service Requirements:
- Must be at least 65 years old or officially disabled if younger.
- Must have been honorably discharged and served at least one day during wartime (combat not required).
- Wartime dates include:
- World War II: Dec 7, 1941 – Dec 31, 1946
- Korean War: Jun 27, 1950 – Jan 31, 1955
- Vietnam War: Aug 5, 1964 – May 7, 1975 (or Feb 28, 1961 – May 7, 1975, if served in Vietnam)
- Gulf War: Aug 2, 1990 – undetermined
- Wartime dates include:
Health Requirements: You must require assistance with daily tasks such as bathing, dressing, or feeding. This benefit is also available if you:
- Are bedridden.
- Are in a nursing home due to physical or mental incapacity.
- Have significant vision impairment.
Financial Requirements: VA&A also includes income and asset limits. For 2024, your net worth must not exceed $155,356, and there’s a three-year “look-back” period on asset transfers, similar to Medicaid. Unreimbursed medical expenses can reduce your countable income, making you more likely to qualify. This means careful planning is often needed to navigate these financial rules.
How to Apply for Veterans Aid & Attendance Benefits
Applying for VA&A benefits involves submitting VA Form 21-2680 (Examination for Housebound Status or Permanent Need for Regular Aid and Attendance) and either VA Form 21P-527EZ (for veterans) or VA Form 21-534EZ (for surviving spouses). These forms are available online through the U.S. Department of Veterans Affairs website, or you can apply in person at your nearest VA regional office.
