Medicaid Pilot Program Helps North Carolina Residents

Millions of Americans function as family caregivers for loved ones. This is one of the most challenging and difficult phases of anyone’s life. At Clarity Legal Group®, we think there is nothing better we can do with our time and experience than serve as support to those caregivers, guiding them through the difficult array of circumstances they may face as a caregiver, all built around the issue of control: control of healthcare decisions, financial accounts, contracts, professional services, and even dispute resolution.  Medicaid planning

Almost all caregivers face the challenge of dealing with issues they have never before faced. It is always easier when the person in need of care has planned in advance to give them the tools they need to help. Ideally we will all do some long term care planning before we need such care. This means putting in place the appropriate legal arrangements necessary to clarify who has control, avoid the difficulties of guardianship, define a strategy for paying for care, and protecting family assets for those who rely on those assets for their well being. Doing this kind of planning, whether it is advance planning ensuring appropriate health care directives are in place, or crisis planning helping someone qualify for Medicaid, is among the most rewarding work we do at Clarity Legal Group®.

Of course, most of us are procrastinators, and sometimes, we neglect to deal with issues which make us uncomfortable or with which we are unfamiliar. Frequently, caregivers are helping without the necessary tools.

Because of our commitment to helping people plan and supporting the vital role caregivers play for so many of our clients, Clarity Legal Group® will play an integral role in today’s Transitions GuidingLights Caregivers Summit in Durham. We are a presenting sponsor of the 2018 Triangle Caregivers Conferences, events dedicated to addressing new approaches and issues in caregiving, while providing advice and education for those caring for loved ones in the Durham area.

As elder law attorneys dedicated to serving caregivers and their families, we understand the challenges illness and infirmity create. I believe we are privileged to be able to contribute to this important event supporting those in our community who work hard to help keep loved ones safe and healthy daily.

Jonathan D. Williams and I will be making a presenation at the Caregivers Summit, speaking from 9:00 to 10:00 AM and again from 10:30 to 11:30 AM on Legal Issues for the Caregiver. The discussion will provide essential information to caregivers on important issues including incapacity planning, guardianship, and cost issues associated with long-term care.

We will focus on how legal arrangements for control works, what planning can and should be done for health care, the importance of avoiding guardianship if possible, the role guardianship plays in the caregiving process when necessary, and address the basics of planning for Medicaid qualification.

Five members of the Clarity Legal Group® team will be available all day at the conference to discuss these and other issues and connect with others in the caregivers community. The conference is at the Sheraton Imperial Hotel near Research Triangle Park. I hope that some of you who are local will find your way to the conference. We will also be speaking to Caregivers on other topics in Chapel Hill, Raleigh and at Campbell University as part of the 2018 Triangle Caregivers Conferences.
