Understanding and Avoiding Estate Disputes: Lessons from the Cannon Mills Trust Case

In a recent high-profile case, the Cannon Mills family and Atrium Health found themselves in a legal battle over a $17 million trust fund. The dispute centered on who should inherit the trust after the death of the original heir, Charles Albert Cannon III. Resolved in North Carolina’s Business Court, the case underscores the critical importance of keeping estate plans up to date and ensuring clear language in wills and trusts.

The Dispute: What Went Wrong?

The disputed trust was created in 1965 by Ruth Coltrane Cannon, the wife of Charles Albert Cannon, who played a significant role in Cannon Mills Co. Ruth Cannon’s original intention was for the trust to support Cabarrus Memorial Hospital following her grandson’s passing. However, over time, Cabarrus Memorial Hospital underwent mergers and transformations, ultimately becoming part of what is now Atrium Health. When the trustees of the family trust attempted to prevent Atrium Health from receiving the trust distributions, a legal conflict ensued.

The legal battle concluded with a settlement that revised the trust to designate new beneficiaries, such as Wake Forest University’s healthcare entities. However, the court acknowledged that differing interpretations of the trust’s original terms made its administration challenging, necessitating legal intervention​.
