A Legacy of Love: Estate Planning for Grandparents

For many, becoming a grandparent is one of life’s greatest joys. Beyond the cherished moments spent together, grandparents often wish to leave a meaningful financial legacy for their grandchildren. Thoughtful estate planning for grandchildren can help ensure that your assets benefit future generations in the ways you intend.

This month, as much of the world focuses on romantic love, we’re thinking about the lasting bonds of familial love. A comprehensive estate plan rooted in your values is a gift of love that keeps giving long after you’re gone.

We get the chance to help them develop their thoughts and be strategic about they accomplish this goal. Here are some key approaches to consider when planning gifts for grandchildren:

Trusts: A Versatile Planning Tool

A trust can provide financial support for your grandchildren while allowing you to set specific conditions on how and when funds are used. For instance, you might establish a trust to cover educational expenses, home purchases, or other major life milestones.

Of course, if your grandchildren are minors it is essential to set up any gift such that a responsible adult is managing the account or accounts. A trust arrangement best accomplishes this. You can pick the Trustee. You can even provide that at some point during adulthood the grandchild might become his or her own Trustee. This same approach is appropriate for young adults who don’t make great decisions about financial matters. A “generation-skipping trust” is another effective option, allowing assets to pass directly to grandchildren while bypassing their parents. This strategy can minimize estate taxes and provide creditor protection. These advantages ensure your grandchildren’s inheritance remains secure even in the face of financial hardships.

529 College Savings Plans: Investing in Education

Education is a priority for many grandparents. A 529 College Savings Plan offers a tax-advantaged way to help with future tuition costs. Contributions grow tax-free if used for qualified educational expenses, and they can also reduce the size of your taxable estate. You can even “front-load” up to five years’ worth of contributions at once without incurring gift taxes. This makes 529 plans a powerful estate planning tool. We encourage clients to avoid defaulting to the use of 529 plans. This is because the plans have the disadvantages of being inflexible and countable for the purposes of college aid applications.

Annual Gifting Strategies: Small Gifts, Big Impact

Annual gifts are a simple yet effective way to transfer wealth to your grandchildren while minimizing estate taxes. In 2025, individuals can gift up to $19,000 per recipient tax-free and without any tax reporting. Married couples can double this amount. Over time, these gifts can provide significant financial assistance. This assistance can be through direct support, contributions to savings accounts, or gifts of appreciated assets. These gifts can be outright or gifts to asset protection trusts for the grandchildren.

Charitable Giving: Passing Down Values

For grandparents who prioritize philanthropy, integrating charitable giving into an estate plan reinforces your values. A charitable remainder trust allows you to donate assets to a cause while still providing income for your family. Alternatively, a donor-advised fund (DAF) enables your family to make ongoing charitable contributions. This fosters a legacy of giving that spans generations.
