8 Common Estate Planning Mistakes and How to Avoid Them in 2025

Common Estate Planning Mistakes

Estate planning is essential for protecting your assets and ensuring your wishes are honored. Unfortunately, even well-intentioned plans can fall short due to common errors. Here’s how to sidestep common estate planning mistakes and create a plan that works as intended.

1. Procrastination

The Mistake: Many people delay creating or updating their estate plan, believing they have plenty of time.

The Fix: Start now. Life is unpredictable. Early planning ensures your loved ones avoid unnecessary complications. Regularly review your plan, especially after major life events like marriage, divorce, or having children.

2. Failing to Fund a Trust

The Mistake: A trust is created but not funded, meaning assets are retitled to be owned by you or Trustor of the trust. Without proper funding, assets will still go through probate, costing your loved ones significant delay and needless expenses.

The Fix: Unlike most estate planning firms, at Clarity Legal Group we work with you to ensure all assets are titled in the name of your trust. This includes bank accounts, real estate, and investments.

3. Overlooking Beneficiary Designations

The Mistake: Beneficiary forms for retirement accounts, insurance policies, or other assets don’t match your plan or are outdated.

The Fix: We will work with you to update beneficiary designations to align with your estate plan. This ensures assets go to the intended recipients without conflict.

4. Neglecting Incapacity Planning

The Mistake: Not preparing for potential incapacity can leave loved ones scrambling for legal authority to manage your affairs.

The Fix: Include a General Durable Power of Attorney and Health Care Power of Attorney in your plan. These documents appoint trusted individuals to make financial and medical decisions on your behalf.

5. Assuming a Simple Will Is Enough

The Mistake: Believing a will alone will cover everything can result in probate delays and missed opportunities for asset protection.

The Fix: Consider creating a Revocable Living Trust. A trust can provide privacy, avoid probate, and allow for advanced planning, such as protecting assets for children or shielding them from creditors or divorcing spouses.

6. Failing to Review Your Plan Regularly

The Mistake: Life and law changes are not reflected in the plan, leading to outdated provisions.

The Fix: Schedule periodic reviews with your estate planning attorney to address updates in tax laws, family dynamics, or financial goals.

7. Ignoring Tax Implications

The Mistake: Overlooking how estate and income taxes affect your legacy can result in unnecessary costs.

The Fix: Consult an experienced estate planning attorney to implement strategies like gifting, charitable trusts, or family limited partnerships to minimize taxes.

8. Choosing the Wrong Fiduciaries

The Mistake: Naming individuals who may lack the time, skills, or willingness to manage your estate responsibly.

The Fix: Select trustees, executors, and agents who are reliable, competent, and understand your goals. Consider a professional fiduciary if no suitable family member is available.

Partnering with an Experienced Attorney

Estate planning mistakes can have lasting effects on your loved ones. Working with an experienced estate planning attorney ensures your plan is tailored to your needs and avoids expensive errors.

At Clarity Legal Group, we take pride in creating custom, comprehensive plans that provide peace of mind and lasting protection.
