If I am married, will everything automatically go to my spouse when I die?

Not necessarily. While some assets may pass directly to a surviving spouse, such as jointly owned property or accounts with designated beneficiaries, others may be subject to probate. Moreover, if there are children from a prior relationship or other heirs, state intestacy laws may divide your estate in ways that do not reflect your intentions.
