No Tricks, Just Treats: How to Avoid Estate Planning Mistakes

Halloween is the season of tricks and treats. 1. Treat: A Plan That Works

Trick: Believing documents alone are enough

It is not enough to sign a Will or Trust and file it away. Estate planning is about more than words on paper. It is about aligning your assets, beneficiaries, and legal documents so they all work together. If your assets are not properly titled or your family is unaware of their roles, even a detailed plan can fall short.

The solution: Work with your estate planning attorney to review how your assets are owned, ensure proper funding of your Trust, and confirm your beneficiary designations are up to date.

2. Treat: Avoiding Guardianship

Trick: Waiting too long to act

Guardianship can be a costly and emotionally difficult process. It often occurs when someone becomes incapacitated and lacks the proper legal tools. Without updated Powers of Attorney or a Living Trust, your loved ones may be forced into court proceedings just to manage your affairs.

3. Treat: A Fully Funded Trust

Trick: Forgetting to transfer assets into your Trust

One of the most common reasons estate plans fail is a Trust that has never been funded. Your Trust can only manage the assets that have been titled into it. If your home, accounts, or investments are not properly transferred, those assets may still end up in probate.

  • Provide copies of essential documents to key people
  • Create a clear action plan for incapacity and death

Trick: Ignoring risks like long-term care or lawsuits
